Chapter 7 Bankruptcy ($750 plus court costs)

In a Chapter 7 Bankruptcy, the debtor (person or married couple filing bankruptcy) will receive a discharge (debts will be wiped away) of all debts which the US Trustee determines are “dischargeable”. Examples of non-dischargeable debts include, but are not limited to: student loans, taxes within the last three years, and restitution from criminal offenses. Generally, all other debts are discharged at the end of the bankruptcy.

It is possible to file for bankruptcy all keep “secured” debts. For example, if you would like to keep your home, it may be possible to do so while simultaneously filing bankruptcy to eliminate credit card debt. Chapter 13 Bankruptcy ($500 up-front plus court costs)

In a Chapter 13 Bankruptcy, the debtor (person or married couple filing bankruptcy) will repay between typically 60-70% of their debts through a typically interest-free debt repayment plan. Chapter 13 Bankruptcy is available to many individuals who would not qualify for a Chapter 7 Bankruptcy either because they earn too much money or because they filed for a Chapter 7 within the last eight years.

Because Chapter 13 Bankruptcy repays most of the debt, certain debts which would not be dischargeable in a Chapter 7 Bankruptcy are in a Chapter 13. Once the debt repayment plan is over, the debtor will generally receive a discharge from all remaining, unpaid obligations.
